Your Privacy

Living Audio C.I.C. takes your privacy very seriously, and we do everything within our means to keep you and your data safe.

We keep the information we need in order to offer you our products and services to a minimum, and we will never sell or share your data without your express permission.

At present, Living Audio C.I.C. chooses not to process credit/debit card payments directly on this site, and we hand you and the contents of your basket over to the payment provider of your choice when you checkout. This means that our systems never see your banking details at any stage. If you have any reason to suspect your banking details are compromised, please contact the payment provider in question directly by visiting their website and using the contact information provided.

Living Audio C.I.C. uses Transport Layer Security (TSL) technology to protect certain pages on the site, specifically all pages in the My Account section. As we are not selling sensitive products or services, we do not feel it is necessary to protect all our pages, just those where you are required to input or read personal data that should be kept safe.

Please do not share your site username or password with anyone else. This information is yours, and yours alone.

If you choose to login using our social login features, you will be granting our systems access to some aspects of your social network experience. However we have tried to keep the information we request from whichever platform you use to a minimum, and this means you may be required to provide additional information by editing your profile in the My Account section.

Living Audio C.I.C. will not share your personal details, including what you purchase and when, with security or law enforcement agencies in the United Kingdom or the rest of the World unless you are specifically named in a legally valid warrant, or we are forced to do so.

Our Products and Services

Living Audio C.I.C. provides an online store of products for you to browse, search and purchase. We reserve the right at any time to remove, add or move any product in the store.

We are also a fully inclusive store, so we will not remove content you may find offensive on religious or other such grounds, unless required to do so by law.

You must be at least 13 years of age to purchase from Living Audio C.I.C.

Digital Products

As we are based in the UK, we are governed by the Sale of Goods Act (1979), and you can read a really well laid out and easy-to-understand explanation of the important details on the Trading Standards website.

If for some reason the download links you receive do not point to the product(s) you purchased, please contact us and we will arrange for the correct links to be sent to the Email address registered on your account.

Download links are valid for 48 hours from the moment they are generated and can only be used 5 times in this period. If you need new links for any reason, please visit the Order History section of My Account, where you can use the self-service system to get new download links.

If your download is faulty in some way, please contact us and we will try to resolve the problem as quickly as possible.

When you purchase digital products from Living Audio C.I.C. you are purchasing the right to possess a digital copy of the audio file or files, which you can move to a hardware player of your choice, burn to a series of audio CDs or a data CD/USB memory storage etc, for your personal use only. You may not provide copies of the audio content to anyone else for free or otherwise, under any circumstances. This also includes any audio content you were given access to for free, unless otherwise stated.

All our content is protected by copyright law, and if we become aware you are distributing our content, we will revoke your account immediately and without warning, and may possibly take additional action depending on the specific circumstances.

Living Audio C.I.C. tries to provide audio content to its blind and print-disabled customers at the lowest possible cost to provide a more enjoyable reading experience, and piracy of our content puts that at risk so please don’t do it.

Because digital products are considered software within the law, and because all our digital products come under the category of sale by sample, once you have completed your payment and received your download links, you will not be entitled to a refund for digital products under any circumstances.

You can request a replacement of the same title if your digital files are faulty in some way, but you cannot exchange your purchase for another product of any kind. This is because when you purchase a digital product, you are purchasing a license only, and no physical goods actually change hands.

Because you are able to verify our digital products by checking out a sample before you purchase, you cannot argue that the product is not as described.

Because our digital products are delivered immediately after purchase, the 7-day cancellation does not apply.

Studio Sessions

As we are based in the UK, we are governed by the Sale of Goods Act (1979), and you can read a really well laid out and easy-to-understand explanation of the important details on the Trading Standards website.

Please note that we operate a 7-day cancellation policy for studio session bookings. This means that if you cancel the session within 7 days of the date and time you reserved, you will forfeit the session and the fee you paid. We do not permit rebooking in these circumstances. The same rules apply if you miss your session for any reason.

If you are unable to attend the date and time you chose when you booked and you are outside the 7-day limit, please contact us to arrange a new date and time.

If you require us to source backing tracks for you to use during your session and we do not receive your requirements before the 7-day cancellation period, you will forfeit the session and will also not be able to rebook.

Our booking system sends out an Email to the Email address you used when making your booking within 5 minutes of the submission button being clicked. If you do not receive the Email within 24 hours after making your booking, please contact us to resolve any issues.

We do not have facilities to work with large bands, choirs or orchestras, but can accommodate solo singers, duos, guitarists etc.

Please note that anyone under the age of 16 must be accompanied by an adult when attending a recording session, and the supervising adult must remain with the minor at all times. No exceptions will be permitted.

If you or anyone in your studio party mis-behaves or acts in an inappropriate manner towards our engineer, you will forfeit your session and be asked to leave immediately.

Alcohol, smoking or drug-use of any kind is not permitted in the studio, however you may smoke outside the studio if you wish.

If you make a booking, you can cancel it and get your money back in full provided you do so within 7 days of the date you made your booking.

Physical Products

As we are based in the UK, we are governed by the Sale of Goods Act (1979), and you can read a really well laid out and easy-to-understand explanation of the important details on the Trading Standards website.

Living Audio C.I.C. may offer physical products in the store. These may include physical media versions of audio/Ebooks, MP3 players, headphones or a range of related products.

You can cancel your order and return your products within 7 days of receipt and receive a no-questions-asked full refund.

We never pay the costs associated with returning an item to us, but we will cover the cost of sending out a replacement product once we receive the item you are returning to us.

If the product you purchased is a CD/DVD/similar physical media product, you will not be able to return it to us if the packaging, including any seal, has not been opened, in exchange for a refund or credit-note. However, you will be entitled to a replacement of the same product which we will send out as soon as we can verify the fault with your original purchase.

We will always do our best to ensure that the site and its content are safe, easy to use and understand, and that our customers behave in a reasonable manner at all times.

We are not responsible for the content of any websites that may be linked to from anywhere on the Living Audio site, but we do try to ensure the sites we do choose to link to are reputable and safe for you to enjoy as well.

We are not Thought Police, and to the extent permissible within UK law, we try to provide an online experience for you that is as comfortable as possible, whatever your background may be, but we expect you to understand that this applies to all our customers which is why we will not remove a particular product because it offends an individual or group of our users simply by being there in the store.

All material on this website is protected by copyright law and is the property of Living Audio C.I.C. unless otherwise stated. You may not copy, screenshot, record via audio or video device, reproduce or in any way make use of the written, graphical or other multi-media materials on any of our pages under any circumstances.

Please note that the American defence of “Fare Use” does not apply to any of our content as we are based in the United Kingdom, and there is no equivalent in UK law at this time.

Audiobooks Of Fan fiction Titles

Some people believe that works of Fan Fiction are not protected by copyright law. This is untrue! Whilst certain elements of a work of fan fiction are not protected because those elements borrow heavily from pre-existing works, there is often a great deal of material that can still be described as original within the law, and as such, is protected by copyright.

Living Audio C.I.C. is one of the only companies producing audiobooks of fan fiction titles, and just like our standard commercial releases, audiobooks of works of fan fiction are protected by copyright in exactly the same way that a music recording or commercial audiobook recording is protected and this is completely unambiguous.

Unlike some parts of fan fiction where copyright is a slightly grey area, no such grey areas exist with recorded audiobook versions of those works, because the recording itself is protected separately from the material that has been recorded.

Blind And Print-Disabled Customers

Customers who are blind or have a recognised print-disability can register for a blind/print-disabled account.

Some of our products may only be available to these customers, some products may be available to these customers at reduced prices or even for free, and some products that are free to the public in general as low-quality online only audio streams may be available to blind and print-disabled customers to purchase as a high-quality downloadable product.

When signing up for a blind/print-disabled account, you are declaring that you have a recognised print disability. You will also be asked to tick a box during signup to confirm your status again.

Living Audio C.I.C. reserves the right to request additional proof of a customer’s print disability at any time. Proof may take the form of a Doctor’s note, letter from a social worker or registered charity or professional or confirmation in writing from a welfare agency of your right to receive disability benefit for a print related disability or blindness.

Failure to present proof of disability should we request it from you, will result in the immediate termination of your blind/print-disabled account until such time as you can produce the required proof.

This will mean that you will lose access to any products you have purchased that were available to you at special rates or for free because of your blind/print-disabled status.

For this reason, we grant you a very generous 60 days from the time we request proof of disability until your account is downgraded or deleted.
